What to Do Immediately After An Accident

If you are seriously injured in an accident as the result of the negligence of another party, the first and foremost thing you should do is to make sure that you receive appropriate medical treatment and care.  You should go to a hospital or see your medical doctor as soon as you can after your injury.  Also, Rogers Law Firm recommends that your report the accident to the police, your employer, the property owner, and/or your insurance carrier.  Furthermore, you should take photographs of the accident scene.

The next most important thing you should do after an accident is to contact a qualified and experienced personal injury attorney to protect your rights (as soon as you can after your injury).  Corpus Christi Tx personal injury lawyer Sheadyn R. Rogers of Rogers Law Firm has helped many injured victims recover fair compensation for damages in personal injury cases such as automobile accidents, trucking accidents, eighteen wheeler accidents, commercial vehicle accidents, motorcycle accidents, premise liability, boating accidents, oil field accidents, product liability, work related accidents, construction accidents, and more.  Mr. Rogers is Board Certified in Personal Injury Trial Law and therefore specializes in Texas personal injury law.

Negligence

The majority of personal injuries cases handled by Rogers Law Firm involve clients who have suffered injuries as the result of the negligence of responsible parties.  The elements of a cause of action for negligence include the following:

  • the responsible party owed a legal duty to the injured victim;
  • the responsible party breached their legal duty;
  • the breach proximately caused injury.

For example, in automobile accident cases, a driver owes to the general public a duty to exercise reasonable care to avoid a foreseeable risk of injury to other drivers.  This duty requires the driver to operate their vehicle at a reasonably safe speed under the circumstances and to avoid distractions such as using their cell phone while driving and/or to avoid driving while under the influence of alcohol or drugs.  The Texas Transportation Code includes many more duties and laws that require a driver to exercise reasonable care to avoid dangerous and reckless conduct to protect other drivers from serious injury and death.
