Q: Do I have to take a Boater Education Course?

If you were born on or after September 1, 1993, yes, you must complete a Boater Education course to operate a PWC or a boat with a horsepower rating of more than 15 hp.

Q: Does the "Open Container" law apply when I'm in my boat?

No. This law, effective 9/1/2001, prohibits the possession of an open container of an alcoholic beverage in the passenger area of a motor vehicle.  It does not apply to watercraft.

Q: Who is required to wear a life jacket on my boat?

All children younger than age 13 must wear a life jacket while in a boat less than 26 feet in length that is underway.

Q: Can I be arrested for Boating While Intoxicated?

Yes.  Alcohol plays a role in approximately 50 percent of all boating accidents.  Game Wardens and Marine Safety Enforcement Officers enforce the Boating While Intoxicated (BWI) law. A person who either appears to be impaired and/or has a blood alcohol level of 0.08 or higher while operating a boat can be arrested for BWI.
